The unfortunate Backdrop to QBG 15/22
A member of the Credit Union had challenged the Accuracy to their personal information that was provided by the Credit Union's Privacy Officer July of 2021, including a Credit Union Letter dated May 7, 2014 that the member alleged was a fraudulent document now attached to the member's file. The member, knowing that the ultimate responsibility for PIPEDA is the Credit Union Board submitted an Official Complaint Under Market Code for accuracy October 6, 2021 to the President (sent regular mail) and the Vice President of the Board (dropped off AT the Credit Union date stamped October 6, 2021) along with individual copies sent to three Credit Union Managers by Express Post with Signatures and dates received. The member's complaint was once again not acknowledged within 5 days under the Market Code complaint handling process.
The member knowing the Credit Union Contravened Market Code by not acknowledging the receipt of their complaint in 5 working days (or at all) knowing their would be no investigation into the October 6, 2021 complaint, started a Twitter account called @McMortgageGate on October 21, 2021. The twitter account never stating the name of the Credit Union but published public court documents from the Credit Union's CMHC Foreclosure Court Action 290/16; which the Credit Union made their name public by executing the original court action with the Court of Queen's Bench.
Instead of the Credit Union Board acknowledging or investigating the members October 6, 2021 complaint, the Credit Union from October 2021 to January 2022 (and still to date); indiscriminately collected, used, and disclosed the members personal information without the members consent for purposes to create the Credit Unions Court action QBG 15/22; another attempt to cause significant financial and moral harm to the individual. PIPEDA considers it inappropriate for an organization to profile, categorize individuals in a way that leads to unfair, unethical and discriminatory treatment which is the backdrop to QBG 290/16 and QBG 15/22.

The Credit Union settlement agreement, was overarching without any considerations of fairness and justice that takes precedence. “contract to make a contract” is not a contract at all. The Credit Union still refuses to provide proper proof of membership or profit share account from 2007 to current date; not even a screenshot of the Credit Union's "Computer Records" (until April, 2023 that did not match the date on the members original membership application). The proposed agreement is null and void and of no effect.
The OPCC complaint was NOT withdrawn but on March 17, 2023; all concerns raised were
well founded and conditionally resolved until December 2023.
April 17, 2023 letter from Credit union states that the OPCC has NOT been found responsible of ANY wrong doing. ( attached ). Member never received the letter prior to mediation, but only after mediation.
The next stage of QBG 15/22 is a request for full disclosure of documentation and witness questioning under oath.
